By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
You may use the Site for lawful purposes and for your own business or professional information. You agree not to use the Site in any way that violates applicable law, interferes with its operation, attempts to gain unauthorized access to any part of it, or copies, scrapes, or reproduces its content except as permitted in Section 2.
The Site and all of its content, including text, graphics, logos, images, frameworks, assessments, tools, and downloadable resources such as the OA Tactical Playbook, are the property of Oetting Alchemy or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. Oetting Alchemy, OA Scorecard™, Board Blueprint™, OA Sprint™, AlchemyOS™, Alchemy90™, Radical Alignment Map™, ERI™, ERI Score™, and the Event Return Index™ are trademarks of Oetting Alchemy LLC. You may view, download, and print content from the Site for your own internal, non-commercial reference, provided you keep all copyright and trademark notices intact. Any other use, including reproduction, distribution, modification, or public display, requires our prior written permission.
Nothing is sold through the Site, and no payment is collected on it. Resources offered on the Site are provided free of charge. Consulting, coaching, facilitation, and speaking engagements with Oetting Alchemy are governed exclusively by a separate written agreement between Oetting Alchemy and the client, and the terms of that agreement, including fees, scope, cancellation, and refunds, control over these Terms.
The content on the Site, including articles, insights, frameworks, scorecards, calculators, and downloadable resources, is provided for general informational and educational purposes only. It does not constitute legal, financial, tax, accounting, or other professional advice, and it is not a substitute for advice from a qualified professional who knows your organization’s specific circumstances. Any figures, scores, or projections shown on the Site are illustrative. Results described on the Site reflect the experience of particular clients and are not a guarantee of results for any other organization. Your outcomes depend on your own decisions, circumstances, and execution.

TO THE FULLEST EXTENT PERMITTED BY LAW, OETTING ALCHEMY AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ITS CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SITE EXCEED ONE HUNDRED DOLLARS ($100). THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND IT DOES NOT LIMIT ANY LIABILITY UNDER A SEPARATE WRITTEN AGREEMENT BETWEEN YOU AND OETTING ALCHEMY.
You agree to defend, indemnify, and hold harmless Oetting Alchemy and its members, officers, employees, contractors, and agents from and against any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your violation of these Terms or your misuse of the Site or its content.
The Site contains links to third-party websites and services, including LinkedIn and Calendly. We do not control and are not responsible for the content, availability, or practices of those sites and services. Links are provided for convenience only and do not imply endorsement.
Client names and logos displayed on the Site identify organizations Oetting Alchemy has worked with. They remain the property of their respective owners, and their display does not imply that any client endorses the Site or any particular result.
These Terms are governed by the laws of the State of Kansas, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Wyandotte County, Kansas, and you consent to the personal jurisdiction of those courts.
We may revise these Terms from time to time. When we do, we will post the revised Terms on this page and update the “Last updated” date above. Your continued use of the Site after any change constitutes your acceptance of the revised Terms.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with the Privacy Policy, are the entire agreement between you and Oetting Alchemy regarding your use of the Site.
